About These Terms

These Terms govern your use of the OBD Ninja application (iOS/Android mobile app and macOS desktop app, collectively the "App") provided by Skyphic (the "Developer"). By downloading or using the App, you agree to be bound by these Terms.

License

The Developer grants you a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Terms of Use

In using the App, you agree not to engage in the following:

• Modifying, reverse engineering, decompiling, or disassembling the App
• Copying, distributing, or reselling the App in whole or in part
• Using the App for illegal purposes
• Using the App in a manner that infringes on the rights of third parties
• Interfering with the normal operation of the App

You are responsible for backing up data within the App.

Subscriptions and Billing

• Plans: Monthly (com.skyphic.obdninja.premium.monthly) and yearly (com.skyphic.obdninja.premium.yearly) plans are available.
• Auto-Renewal: Subscriptions automatically renew before the current period ends. To stop auto-renewal, cancel at least 24 hours before the current period ends through your device settings.
• Billing: Subscription fees are billed through the Apple App Store or Google Play Store. The Developer does not handle payment information directly.
• Refunds: Refunds are subject to the refund policies of each platform (Apple / Google). The Developer cannot independently process refunds. Please contact Apple or Google directly for refund requests.
• Price Changes: Subscription fees may change. If a price change occurs, you will be notified in advance.

Vehicle Data Disclaimer

• The Developer does not guarantee the accuracy, completeness, or reliability of OBD-II data. Data precision may vary depending on the vehicle, OBD-II adapter, and communication conditions.
• Any vehicle maintenance or repair decisions based on information from the App are made at your own risk. For important maintenance decisions, always consult a qualified mechanic.
• The Developer assumes no liability for vehicle damage, repair costs, or other losses resulting from errors in the App's diagnostic data.

Disclaimer Regarding Use While Driving

• Always comply with traffic laws and related regulations while using the App.
• The Developer assumes no liability for accidents, injuries, death, or property damage caused by operating the App while driving (checking the screen, changing settings, etc.).
• Use the dashcam feature only in ways that do not compromise driving safety. Start recording before driving and avoid operating the App while driving.
• Speed displays and other real-time data in the App are not a substitute for your vehicle's instruments.

Intellectual Property

All copyrights, trademarks, and other intellectual property rights related to the App belong to the Developer. These Terms grant you only a right to use the App; no transfer of ownership is implied.

Disclaimer of Warranties

The App is provided "as is." The Developer makes no warranties, express or implied, regarding the completeness, accuracy, reliability, or fitness for a particular purpose of the App.

• The Developer assumes no liability for any direct, indirect, incidental, or special damages arising from the use or inability to use the App.
• If disputes arise between you and third parties in connection with your use of the App, you shall resolve them at your own responsibility and expense, and the Developer assumes no liability.
• The Developer assumes no liability for data loss or corruption due to device failure, communication disruptions, or other technical issues.

Updates and Support

The Developer does not guarantee the provision of updates or technical support for the App. If updates are provided, these Terms continue to apply.

Changes to These Terms

The Developer may modify these Terms. If significant changes are made, you will be notified at least 30 days before the effective date through in-app notifications or website postings. If you continue to use the App after the changes, you are deemed to have accepted the modified Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of Japan. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance. However, for customers residing in the EEA, mandatory provisions of consumer protection laws in your country of residence may take precedence.
